TOWN OF EAST LONGMEADOW

SPECIAL TOWN MEETING

DECEMBER 18, 2000

 

In accordance with the warrant of the Selectmen, the Special Town Meeting was held in the Auditorium of the East Longmeadow High School on Monday, December 18, 2000.  Town Moderator, Richard Brown called the meeting to order at 7:10 P.M. there being more than a quorum present.  Mr. Brown offered the opening prayer and also led the assembly in the Pledge of Allegiance.

 

Mr. Brown paid tribute to Rev. Edgar H. Forrest who passed away recently.   Rev. Forrest had traditionally offered the opening prayer at Town Meetings for many years.

 

 

 

ARTICLE 1

Zoning By-Law Amendment

Voted that the Town amend the East Longmeadow Zoning By-Law, 1991 Revision by clarifying specific language as follows:

 

To correct a typographical error in the Table of Dimensional Regulations to conform with the text as written in section 7.34, page 7-11.  Specifically:

 

Table 3.2, pages 3-12, 3-13, 3-14, and 3-15:

 

"Miminum Frontage (feet) for a Church, Building for Educational purposes, Public Library, Museum" to read as follows:

 

Residence AA:            350 feet

Residence A:            280 feet

Residence B:            200 feet

Residence C:            150 feet

 

Additionally, for clarification, to insert "see section 7.34." under the Comment column.

 

Passed Unanimously.

 

ARTICLE 2

Zoning By-Law Amendment

Voted that the Town amend the East Longmeadow Zoning By-Law, 1991 Revision by clarifying specific language as follows:

 

To delete the existing paragraphs and replace with language to read as follows:

 

Section 7.41:  Projects Requiring Site Plan Review:

Article 2 cont.

"Notwithstanding anything contained in the by-law to the contrary, no building permit for the construction, exterior alteration, or relocation, occupancy or change in use of any building, structure or premises shall be issued, nor shall an occupancy certificate for any new occupant, or any change of use of a building, structure, or premise be issued, without Site Plan Review and approval by the Planning Board; provided however, that a single family dwelling not within a residential development shall be exempt from these provisions.  It is the intent of this section that no individual, corporation or any business entity, regardless of the form chosen, shall occupy any building structure or premises or change the use thereof or the construction or alteration to the exterior of any structure without first complying with the provisions of Site Plan Review.

 

For the purposes of this Section of the By-law, a Residential Development is any residential use of land made possible by the provision of adequate frontage through the subdivision of land.  No permit for the construction of a single-family dwelling located within a Residential Development shall be granted until the Planning Board has reviewed and approved a Site Plan for the Residential Development as required by this Section.  A Residential Development shall be considered to be a single project for the purposes of Site Plan Review.

 

Further, if the Planning Board determines that there is no substantive change in use and the proposed use is less detrimental than its present or immediate prior use and that the external enlargement, if applicable, is less than 2,000 (two thousand) square feet, the Board may waive any or all of the requirements of Site Plan Review."

 

Passed Unanimously.

 

 

 

 

ARTICLE 3

Parking Easement

Voted that the Town authorize the Board of Selectmen to enter into an agreement or agreements for cross parking easements with any or all of the owners of property lying between Crane Avenue and North Main Street or their successors, heirs or assigns and that the Board be authorized to grant an easement or easements to any or all of said owners or their successors, heirs or assigns for off street parking of vehicles on municipal property located between Crane Avenue and North Main Street in exchange for the grant of an easement or easements from any or all of said owners and their successor, heirs or assigns for off street parking of vehicles on property owned by them lying between said Crane Avenue and North Main Street, on such terms and conditions as the  Board determines to be in the best interest of the Town.

ARTICLE 4

Transfer of Funds - Study of School Expansion Requirement

Voted that the Town appropriate the sum of $95,000 from the Undesignated Fund Balance for preliminary design/engineering services to study the expansion requirements of the school system to include but not be limited to, building a new elementary school; and that the Building Committee is authorized to take any other action necessary to carry out this preliminary planning.

 

Standing Vote:    Yes 170,    No 70

Special Town Meeting was adjourned at 8:20 P.M., the business of the Warrant having been completed.
