In accordance with the warrant of the Selectman, a Special Town Meeting was held in the Auditorium of the East Longmeadow High School on Monday evening, June 20, 2005. Town Moderator, Mr. James Sheils called the meeting to order at 7:13 PM there being 443 registered voters present. Mr. Sheils offered the opening prayer and led the assembly in the Pledge of Allegiance. Mr. Sheils then proceeded with some housekeeping issues: The formation of a Town Meeting Rules Committee for future Town Meetings and The Town Moderator will be in charge and make the final judgment on votes requiring a 2/3 majority vs. a teller count, i.e., if a small amount of nays are heard and it is under the majority needed, the Town Moderator can pass the motion without a teller count.

Voted to accept the provisions of the Massachusetts General Laws, Chapter 44B, Sections 3-7, known as the “Community Preservation Act” which establishes a special “Community Preservation Fund” that may be appropriated and spent for certain open space and historic resources and to approve a property tax surcharge in an amount not to exceed one per cent of taxes assessed annually on real estate property for fiscal years starting July 1, 2006.

Voted to authorize the Board of Selectman, by virtue of Massachusetts General Laws, Chapter 40, sections 3 and 3A, to release the town’s interest in a storm drain easement located on Lot 17 Favorite Lane, as recommended by the Board of Public Works and the Planning Board.

Amend the Zoning By-Laws
to Insert a new Section 5.3A Entitled “Planned Adult Residential District” to
Provide Housing for People Primarily 55 Years of Age or Older.
Voted to amend the Zoning By-laws to insert a new Section 5.3A entitled “Planned Adult Residential District” to provide housing primarily for people 55 years of age and older; to amend Table 3-1 and Table 3-2 of said by-laws to conform to Section 5.3A and change from Garden Park District to Planned Adult Residential District for properties located at 420 Chestnut Street, 382 Chestnut Street and Benton Drive owned by Rugby Properties, LLC.

by Changing from Industrial District/Residential to Industrial District for a
Parcel of Land Located at 94 Maple Street.
Voted to amend the Zoning by-laws by changing from Industrial District/Residential to Industrial District a parcel of land owned by the Kennedy Ford Realty Group, LLC located at 94 Maple Street containing 34,400 square feet.
Motion Failed.
