WARRANT FOR SPECIAL TOWN MEETING—JUNE 20, 2005

COMMONWEALTH OF MASSACHUSETTS

TOWN OF EAST LONGMEADOW

 

HAMPDEN, ss:

 

To the Constables or the Tax Collector for the Town of East Longmeadow:

 

            In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of said Town of East Longmeadow, Massachusetts to meet on Monday, June 20, 2005 at 7 o’clock in the evening, in the auditorium of the Senior High School, at which time and place action upon the following Articles will be taken:

 

ARTICLE 1.  To see if the Town will vote to accept the provisions of the Massachusetts General Laws, Chapter 44B, Sections 3-7, known as the “Community Preservation Act” which established a special “Community Preservation Fund” that may be appropriated and spent for certain open space, historic resources and affordable housing purposes, to approve a property tax surcharge in an amount not to exceed one per cent of taxes assessed annually on real property which shall be dedicated to the Fund; such surcharge to be imposed on taxes assessed for fiscal years beginning on or after July 1, 2006, and to exempt from the surcharge any or all of the following: (1) Property owned or operated as a domicile owned by a person who would qualify for low-income housing, or low-to-moderate income senior housing in the community; or (2) $100,000 of the assessed valuation of Class One, Residential, parcels; and pass any vote or take any other action relative thereto.

ARTICLE 2.  To see if the Town will vote to authorize the Board of Selectmen, by virtue of Massachusetts General Laws Chapter 40, sections 3 and 3A, to release the town’s interest in a storm drain easement located on Lot 17 Favorite Lane, as recommended by the Board of Public Works and the Planning Board; and pass any vote or take any other action relative thereto.

ARTICLE 3.  To see if the Town will vote to amend the Zoning By-laws of the Town of East Longmeadow to insert a new Section 5.3A entitled “Planned Adult Residential District” to provide housing primarily for people 55 years of age and older; and to amend Table 3-1 and Table 3-2 of said By-laws to conform to Section 5.3A and that the Town amend the Zoning By-laws by changing from Industrial Garden Park District to Planned Adult Residential District a parcel of land owned by Rugby Properties, LLC, located at 420 Chestnut Street, (Assessor’s Map 7, Block 5, Lot 0) containing 34.70 acres; and by changing from Residence A District to Planned Adult Residential District a parcel of land owned by Rugby Properties, LLC, located on Chestnut Street (Assessor’s Map 7, Block 4, Lot 0) containing 17.50 acres; and by changing from Residence A District a parcel of land owned by Rugby Properties, LLC, located at 382 Chestnut Street (Assessor’s Map 7, Block 3, Lot 0) containing 40,350 square feet; and by changing from Industrial Garden Park District to Planned Adult Residential District a parcel of land owned by Rugby Properties, LLC, located on Benton Drive (Assessor’ Map 8, Block 9, Lot 16A) containing 1.156 acres; and pass any vote or take any other action relative thereto.

ARTICLE 4.  To see if the Town will vote to amend the Zoning By-laws of the Town of East Longmeadow by changing from Industrial District/Residential to Industrial District a parcel of land owned by the Kennedy Ford Realty Group, LLC located at 94 Maple Street containing 38,400 square feet.
